Rare, Fine & Limited Signed Book Giveaway Rules

1. Eligibility: The RFL Signed Book Giveaway (the “Giveaway”) is open to legal residents of the United States, who are 21 years of age or older at the time of entry. Void where prohibited or restricted by law.
   
   Employees, officers, directors, trustees, and agents of Find Familiar Spirits, Seelbach’s Distribution, & Manifest Distilling and their immediate family members or those living in the same household are not eligible to participate. “Immediate family members” shall mean parents, step-parents, children, step-children, siblings, step-siblings, grandchildren, step-grandchildren, or spouses, regardless of where they live. “Household members” shall mean people who share the same residence at least three consecutive months a year, whether related or not. Potential winners may be required to provide proof of eligibility upon request prior to prize award.
2. Entry Period: The Giveaway begins at 6pm Pacific Time (“PT”) on October 2nd, 2024 and ends at 11:59 p.m. PT on October 23rd, 2024 (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible.
3. How to Enter: No purchase necessary to enter or win. During the Entry Period stated above, participants must go to MacabreSpirits.com (the “Website”) and sign up to be on the Macabre mailing list. Limit one (1) online Giveaway entry, per eligible person, during the Entry Period.
   
   Any attempt by an Entrant to obtain more than the stated number of entries by using multiple or different email addresses or identities will void that Entrant’s entry and that Entrant may be disqualified. In the event of a dispute as to the identity of a potential Winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry and such individual will be required to comply with these Official Rules. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted e-mail address. Any potential Winner may be required to show proof of being the authorized account holder.
4. Prize: Ten (10) winners will be chosen to receive a copy of the novella, Rare, Fine & Limited signed by Matthew Lillard and Mike Flanagan (the “Prize”). Eligible winners must provide a valid shipping address to receive the Prize. The Prize is non-transferable and cannot be substituted for cash.
5. Winner Selection: The winners will be selected in a random drawing from all eligible entries received during the Entry Period. The drawing will be conducted by assigning each Entrant a number based on the order in which they signed up on the mailing list, then a random number generator will be used to produce the 10 winning numbers (and 10 alternates) within 7 days after the Entry Period ends. The odds of winning depend on the number of eligible entries received.
6. Winner Notification/Verification: (a) The potential winners will be notified via email within 2 days of the drawing. The potential winners must respond within 7 days of notification and provide their full name, mailing address, and/or any other required information to claim the prize. If the potential winner does not respond within the specified Time Period or fails to comply with these Official Rules, another winner will be selected from the list of alternates in the order in which they were drawn.

 
(b) Find Familiar Spirits and its agents are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the Giveaway is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures beyond Find Familiar Spirits’ control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Giveaway, Find Familiar Spirits reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to terminate, modify or suspend the Giveaway. Notice of termination/modification/suspension of the Giveaway will be posted on the Website. No responsibility is assumed for technical problems or traffic congestion on the internet or at any website, or any combination thereof, including any injury or damage to Entrant’s or any other person’s computer related to or resulting from participation in or downloading any materials from this Giveaway.

Entrants further agree not to knowingly damage or cause interruption of the Giveaway and/or prevent others from participating in the Giveaway. Any attempt by an Entrant or any other individual to damage any online service or Website or otherwise undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws. If such an attempt is made, Sponsor may disqualify any Entrant making such attempt and reserves the right to cooperate in the prosecution of any such individual and to pursue all remedies to the fullest extent permitted by law.

1. Publicity: By accepting the prize, the winners agree to allow Find Familiar Spirits to use their name, likeness, voice, biographical information, and/or written or oral statements, for advertising and promotional purposes in connection with the Giveaway, and/or the institutional promotion of Find Familiar Spirits, without further consideration, review, approval or payment, where allowed by law.
2. Approximate Retail Value Of The Prize: The approximate retail value (the “ARV”) of the prize is $100. Any difference between stated ARV and actual value will not be awarded. Odds of winning the Prize depend on the total number of eligible entries received during the Entry Period. In the event that a potential winner is unable to receive the Prize for any reason, the potential winner forfeits the Prize which is non-transferable and cannot be substituted for cash.
3. Release and Limitations of Liability: By participating in the Giveaway, entrants agree to release and hold harmless Find Familiar Spirits, and their respective affiliates, subsidiaries, advertising and promotion agencies, and each of their respective officers, directors, employees, and agents from and against any claims, costs, injuries, losses or damages of any kind arising out of participation in the Giveaway or receipt or use of any prize, including, but not limited to: (a) any technical errors that may prevent an entrant from submitting an entry; (b) unauthorized human intervention in the Giveaway; (c) errors in the administration of the Giveaway or the processing of entries; (d) any technical errors that may affect shipping; or (e) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt of any prize.
   
   In the event Find Familiar Spirits is prevented from continuing with the Giveaway by any event beyond its control, including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within the Find Familiar Spirits’ control, Find Familiar Spirits shall have the right to modify, suspend, or terminate the Giveaway. Neither Find Familiar Spirits nor any service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or Web site, or any other error or malfunction, or any injury or damage to participant’s or any other person’s computer related to or resulting from participation in this Giveaway. 
   
   Official Rules will be posted at the Website during the Giveaway Entry Period. 
   
   Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
4. Dispute: Except where prohibited, entrant agrees that (a) any and all disputes, claims, and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved solely through binding arbitration; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys’ fees; (c) under no circumstances will an Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased, and each Entrant irrevocably waives any right to seek injunctive or equitable relief.
5. Governing Law/Jurisdiction: All disputes arising hereunder or in relation to the Giveaway and/or the Prize, shall be brought solely and exclusively in the appropriate court located in Illinois, and all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of Find Familiar Spirits in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of Illinois, without giving effect to any choice of law or conflict of law rules (whether of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Illinois and Entrant hereby consents to the jurisdiction of such courts and waives any defense of inconvenient forum. The parties agree that any dispute between the parties shall be referred by the relevant court in Illinois to binding arbitration, which shall apply Illinois law and procedure to any arbitration procedures.
6. Sponsor: The Giveaway is sponsored by Find Familiar Spirits, 1241 Central Ave., Ste. 794, Wilmette, IL 60091. This Giveaway is in no way sponsored, endorsed, administered by, or associated with any social media platform or entity.
7. Winner List: To request a copy of the winners’ names, send an email with the subject line “Winner List Request” to [email protected]. Requests must be received within 30 days after the end of the Entry Period.
8. Terms: By participating in the Giveaway, entrants agree to be bound by these Official Rules and the decisions of Find Familiar Spirits, which are final and binding in all respects. Entrants consent to receive newsletters and other promotional e-mails from Find Familiar Spirits. Find Familiar Spirits reserves the right to modify or terminate the Giveaway at any time, and to disqualify any Entrant that they determine, in their sole discretion, to be tampering with the entry process or violating these Official Rules.
